American Canoe Association Volunteer Cleanup Participation: Assumption of Risk
Thank you for participating in waterway cleanup activities. The American Canoe Association (ACA) is providing you with a Waterway Cleanup Kit, but please note that the ACA is not organizing or overseeing the cleanup event. You are solely responsible for your participation. By receiving this kit and participating in the cleanup activities, you acknowledge and agree to the following:
Voluntary Participation
Your participation in waterway cleanup activities is completely voluntary. The ACA is only supplying the cleanup materials and is not responsible for organizing, supervising, or overseeing the activities in which you participate. You are acting independently and are not an employee, agent, or representative of the ACA.
Assumption of Risk
Waterway cleanup activities involve inherent risks, which may include physical exertion, exposure to hazardous waste, inclement weather, water hazards, and interactions with wildlife. By choosing to participate, you acknowledge these risks and voluntarily assume full responsibility for your safety. It is your responsibility to use good judgment, follow safety guidelines, and exercise caution during all activities.
No Liability for ACA
The ACA, its officers, directors, employees, agents, and affiliates are not responsible for any injuries, property damage, illness, or death that may occur as a result of your participation in the waterway cleanup activities. ACA is not liable for any risks or consequences related to your voluntary participation in these activities.
Indemnification
You agree to indemnify and hold harmless the ACA from any claims, actions, or demands made by third parties resulting from your participation in cleanup activities, including those arising from your own negligence, failure to follow safety guidelines, or misuse of the provided cleanup materials.
No Warranties or Guarantees
The ACA makes no representations or warranties about the safety, effectiveness, or suitability of the cleanup kit or any of its contents. You are responsible for using the materials properly and safely.
Medical Treatment
ACA is not responsible for providing medical care in the event of an injury. You are responsible for your own medical expenses if any injuries or health issues arise while participating in cleanup activities.
Acknowledgment
By accepting the Waterway Cleanup Kit and engaging in the cleanup activities, you acknowledge that the ACA is not organizing or overseeing the event. You understand that you are participating at your own risk, and that you are solely responsible for your safety and actions during the cleanup process.
